Copyright Bootcamp 2: Critical Exceptions & Limitations to Copyright

The ACRL New England Scholarly Communication Interest Group (SCIG) invites you to an advanced copyright bootcamp on the critical exceptions to copyright law used by libraries and archives that support digitization efforts for archival preservation and exhibitions, electronic reserves, streaming media, or controlled digital lending. Topics discussed include §107 (fair use), §108 (reproduction by libraries and archives), and §109 (first sale). The bootcamp will be led by Laura Quilter (Copyright and Information Policy Librarian, UMass Amherst), Kyle K. Courtney (Program Manager & Copyright Advisor, Harvard University), and Katie Zimmerman (Scholarly Communications and Licensing Librarian, MIT Libraries).

Program Schedule

10 a.m. - Noon: Sections 108, 109, 107

During the morning session, we delve into the exceptions and limitations that libraries rely on to support digitization efforts, whether for archival preservation and exhibitions, electronic reserves, streaming media, or controlled digital lending. This will be a deep inquiry into Sections 107, 108, and 109 of the Copyright Act, and attendees should have a basic familiarity with this material. We will examine how these provisions have been applied in case law and in legal reasoning, policy, and practice at libraries.

Noon - 1 p.m.: Lunch

1 - 3:30 p.m.: Fair Use & Workshopping
This afternoon, we'll explore copyright and digitization issues that your library or organization are dealing with. We'll workshop these issues together, go over sample hypotheticals, and do some interactive fair use voting.
